The American Subcontractors Association (ASA) is the only organization solely dedicated to protecting and promoting the interests of subcontractors. Advocacy

​ASA of California is the united voice dedicated to improving the business environment in the construction industry, representing subcontractors and material suppliers before all branches (executive, legislative, judicial) and levels (federal, state, local) of government, in collaboration with organizations representing other parts of the construction industry, to the news media, and others.

Membership

​Any person, firm or corporation in the normal course of business that furnishes subcontract labor and/or materials to the construction industry or provides a service to such subcontractors or material suppliers is eligible for regular membership in the association

Education

ASA of California offers subcontractor - tailored events and education including Members-only educational resources ranging from model contract language to risk management and marketing tools. We also offer in-person and distance-learning educational events open to members and nonmembers.

Legislative Accomplishments

The American Subcontractors Association of California (ASAC) is your voice in Sacramento.

ASAC is recognized as a leading voice for California’s subcontractors and suppliers, with a focused
and effective presence in the State Capitol. We educate the State Legislature and other key
decision-makers on the essential role subcontractors and the construction industry play in
California’s economy.

Through our Government Relations Committee (GRC), members help shape ASAC’s positions
on key legislation impacting your business.  Generally, ASAC works to advance policies that
support job creation, fair business practices, and long-term industry growth.  We protect against
unfair risk-shifting, payment delays, and policies that harm subcontractors.

ASAC is proudly represented in Sacramento by McHugh Koepke Padron Government Relations (MKP). 
Our MKP advocates work directly with the lawmakers and the Governor’s office to protect and advance our members’
priorities.

Some recent notable achievements include:

  • Supporting Retention Reform: Secured a 5% cap on retention for public works projects (AB 2173, 2022).  In 2025, ASAC is working to push legislation (SB 61) capping retention on private construction projects at 5%, aligning private sector practices with the fair and proven standards already in place for public works.

  • Supporting Payment Protections: ASAC is actively supporting legislation (SB 440) to establish a process for contractors and subcontractors to recover private works construction payments for change orders.

  • Supporting Better Business Environment: ASAC, as part of the broader business community, supported the Private Attorneys General Act (PAGA) reform in 2024. 

  • Opposing Burdensome Reporting Requirements: This year, ASAC fought against legislation that would have annual reporting of emissions and climate-related financial risk (AB 1223). We have also successfully stopped measures that would impose severe and disproportionate burdens on subcontractors, particularly small and medium-sized businesses (AB 3186, 2024 and SB 1340, 2024).

Historically, ASAC has also successfully advocated for indemnification reform, prompt payment, lien rights, surety bonding, and more.  Your ASAC membership helps us continue this important work.
